Bookings and electronic contract
Bookings are made online, from this website or from the booking page operated by the Beds24 platform (channel manager), as well as through partner platforms. Card payments are processed by Stripe Payments Europe, Ltd.; MAN GEST never has access to the guest's full card details.
In accordance with articles 1125 to 1127-6 of the French Civil Code and with Act no. 2004-575 of 21 June 2004 on confidence in the digital economy, a booking made online constitutes a contract concluded in electronic form. Such a contract has the same evidential weight and the same legal force as a contract drawn up on paper.
The contract is formed when the guest, having been able to check the details of the booking and its total price and to correct any errors, confirms it by validating payment. That validation constitutes an electronic signature and full acceptance of these terms. A confirmation email setting out the terms of the contract is sent to the guest, who is advised to keep it.
Under articles 1366 and 1367 of the French Civil Code, the electronic records kept by MAN GEST and by Beds24, under reasonable security conditions, are deemed to be evidence of the communications, bookings and payments between the parties. The contract is concluded in French; in the event of any discrepancy between translations, the French version prevails. It is archived by MAN GEST for the period required by law.
Prices and payment terms
Prices are shown in euros, all taxes included. Cleaning fees and, where applicable, tourist tax are shown in the summary before the booking is confirmed.
- Booking made more than 28 days before arrival — a deposit of 30% of the total price is charged at the time of booking. The remaining 70% is charged automatically, to the same payment method, 28 days before the arrival date. By confirming the booking the guest expressly authorises this deferred charge.
- Booking made 28 days or less before arrival — the full amount is charged immediately.
Sums paid are part payments and not earnest money within the meaning of article 1590 of the French Civil Code: they bind both parties definitively, subject to the cancellation rights set out below.
If the balance payment fails, MAN GEST will notify the guest by email. Failing settlement within 72 hours, the booking may be cancelled automatically and the 30% deposit retained by MAN GEST.
Cancellation and changes
- Booking made more than 28 days before arrival — free cancellation up to 28 days before the arrival date: the 30% deposit is refunded in full.
- After that 28-day point — the booking can no longer be cancelled. The full price remains payable to MAN GEST whatever the date of cancellation, including in the event of a no-show or early departure.
- Booking made 28 days or less before arrival — free cancellation within 24 hours of the booking confirmation, with a full refund. After those 24 hours the booking is firm and final and no refund can be obtained.
Cancellation requests must be made in writing, by email or through the contact form; the date of receipt applies. Refunds are made to the payment method used for the booking, within fourteen days at most.
Any request to change dates is treated as a new booking, subject to availability. Guests are advised to take out cancellation insurance.
Right of withdrawal
Under article L. 221-28, 12° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to accommodation services to be provided on a specific date or during a specific period. The guest therefore has no right of withdrawal: only the cancellation rights described above apply.
Security deposit
No security deposit is charged or held on the guest's account. The details of the card used for the booking are stored securely by Stripe Payments Europe, Ltd., a PCI-DSS certified provider; MAN GEST never has access to them in plain form.
By confirming the booking, the guest authorises MAN GEST to charge that card, up to €1,500 for Villa Accelasca and €500 for each of the other properties, in the event of damage, loss, theft, exceptional cleaning or exceeding the stated number of guests. Any such charge is preceded by written notice to the guest and supported by photographs, a report or a quotation. These limits do not cap the amount of damages that may otherwise be claimed.
Governing law and disputes
The contract is governed by French law. Any complaint should first be sent to MAN GEST through the contact form. Under articles L. 612-1 et seq. of the French Consumer Code, the guest is entitled to use a consumer mediator free of charge with a view to the amicable resolution of a dispute.
